Asylum Explained

A guide to the process of seeking asylum in Australia

There are two possible decisions which could be made in your case.

If you have been granted a Protection visa

If you are granted a Protection visa, then you will receive a “visa grant notice” informing you that you have a Protection visa. To find out more about what a Protection visa is and what it means for you if you are given a Protection visa, please click here.

If your Protection Visa application is refused

If your Protection visa application is refused then you will receive a written record of the reasons for the decision and a copy of the interview recording. If your Protection visa application is refused you can have your case reviewed by the Refugee Review Tribunal (RRT). You have 28 days from being notified of the DIAC decision if you received the decision by fax or by email. If you received it by post you have an extra 7 working days to send your application to the RRT. If you are in detention you have 7 days to send your application to the RRT from when you are notified of the decision.

It is very important that you lodge your application for review with the RRT before the time limit expires. If you miss this deadline you will lose your right to go to the Tribunal.
